Reasonable Caresm Program

Wellington Environmental’s Reasonable Caresm series builds a strong procedural base for managing the risks associated with hazards that may harm people. The base is formed by four basic operations.

  • Obtain information about the hazard
  • Develop procedures for controlling exposures to the hazard
  • Communicate information about the hazard as well as appropriate control measures and policies to your employees and contractors who may work in your facility
  • Document your actions showing you took reasonable steps in managing the hazard

The successful implementation of the Reasonable Caresm Program provides two great rewards. The first reward is that you can provide a safe and healthy environment for your employees, contractors, and visitors to your facility. The second reward is that you have started the process of documenting your actions of taking reasonable care to protect people from hazards. This document will be extremely valuable in the event of future disputes, litigation or arbitration.

Wellington Environmental’s Reasonable Caresm series consists of:

Reasonable Caresm Program for Asbestos Management

Asbestos risks are faced with endless conflicting opinions causing additional questions to be asked: Who is responsible? How can we protect ourselves? What is the best proactive approach?

Wellington Environmental's Reasonable Caresm Program includes the development and maintenance of a thoughtfully planned and executed program, in addition to asbestos management and record keeping. The program provides a step-by-step action plan to evaluate and reduce the risk of asbestos exposure, communicate plan to all involved, train personnel and document actions taken, specifically designed to assist and protect building owners (reducing the prospect of corporate liability), employees and tenants.

Asbestos management is a complex and important task that must be properly executed in order to protect a buildings occupants and reduce an owner's legal liabilities. Ongoing adherence to the Reasonable Caresm Program can satisfy both of these concerns.

The Reasonable Caresm Program for Asbestos is being used by corporations and institutions across the United States.

Let me give you a brief background on why this program is important.

We have been working for the U.S. Army for the last seven (7) years as expert witnesses and as a team member in arbitration cases, all over the country involving asbestos. These are legal actions brought by workers in government facilities not because of any known disease (such as asbestosis or mesothelioma) but just because they had to work in what they considered to be hazardous conditions due to the asbestos in the buildings where they worked. We are now seeing these and similar legal actions spill over into the private sector. The lawyers in these cases keep telling me that if we can prove that the facility took reasonable care of the asbestos then we can win these cases. Consequently, we developed a program and patented it, called Reasonable Care. We jammed our manual full of ideas and things you need to know to defend yourself, your actions and the facility in the event someone sues concerning asbestos.

Our clients have been using our Reasonable Caresm Program to plan and document actions taken concerning asbestos. If a lawsuit occurs, the Reasonable Caresm Program keeps all of your decision-making documentation in one easy to find place. In addition, the Reasonable Caresm Program has been updated with regards to the latest OSHA Asbestos Standard for Construction and General Industry.
